| Validity | The Acceptance Document remains valid until the date of real estate closing or for a maximum of 12 months, whichever comes first. |
| Winter rule | If snow cover prevents access, a Conditional Acceptance Document can be issued if the county-licensed inspector certifies in writing the property was inaccessible and payment was made up front for an inspection as soon as conditions allow, and the buyer agrees in writing to complete the inspection (and any needed repairs within 90 days) when conditions allow. Frozen ground preventing repairs likewise allows a conditional document with repairs on a county-approved timeline. |
| If the system fails | The county may issue a Conditional Acceptance Document if the buyer agrees in writing to obtain a repair/alteration permit and complete all repairs within 90 days of closing. |
| Exemptions | Exempt: OWTS installed and finaled, or repaired/altered under permit, within 4 years of sale; properties on municipal/sewage-treatment-works sewer; systems permitted by the State for more than 2,000 gallons/day; undeveloped properties with no OWTS; property conveyed on a death with a testamentary document; initial transfer resulting from foreclosure or forfeiture; and where the owner holds an unexpired repair/alteration permit and the repair obligation was disclosed to the buyer. |
