Eagle County: septic rules when you sell

OWTS Adequacy Review (OAR) Permit

Eagle County adopted new septic (OWTS) regulations on January 20, 2026, creating an OWTS Adequacy Review (OAR) Permit. Point-of-sale inspections are NOT yet mandatory: the OAR requirement for real estate transfers does not take effect until January 1, 2027. Until then, an OAR permit is not required to sell a home with a septic system.

Inspector requirement For the 2027 OAR program, inspectors must hold an active NAWT inspector certification and an Eagle County-specific license for their scope of work (county licensing required as of March 6, 2026).
Inspection at sale Starting January 1, 2027, an OWTS Adequacy Review (OAR) permit with a certified inspection will be required for all property sales. This requirement is NOT in force before that date.
Program adopted Regulations adopted January 20, 2026; general regulations effective March 6, 2026 (45 days after adoption). The point-of-sale OAR requirement (Section 4.L) is delayed until January 1, 2027.
